  • AP after applying for family green card

    I am a citizen. My father arrived as a visitor and I have applied for my father's greencard on family category using adjustment of status.
    Fingerprinting is completed. Now we would like to take my father with us to india for vacation. After applying for adjustment of status from visitor category to green card, can we apply for Advanced parole as well. Now it is jun, we would like to travel end of july. Is it possible to get advanced parole approved by then?

    AOS pending person should not travel without AP. Also, if he overstayed his visitor visa, it is recommended that he not travel as AP re-entry is not a given for such cases.

      He is not overstayed his visitor visa, so can we apply for advanced parole and then leave US, without waiting for any approvel for advanced parole.

      Will that affect in any way the green card filed or reentry to US , also I have just received a query for the green card filed, will that have any impact?

        No. He can not leave without the approved AP document.

        You must apply for Advance Parole and WAIT until it is approved. Once it is approved and you got it in your hands, then you can leave. If the person leaves the USA before the AP is approved, then the I-485 application is deemed abandoned.

          I applied for green card and advanced parole with Chicago box office for my mom on 4/10 and I just got an approval to travel from National Service Center in Missouri today so it takes two months. They said it can take up to three months. I would not travel before getting this document.
