  • EAD and working

    Hi,
I am looking to move from my current H1-B in an IT company into an EAD. Its been more than 180 days since I got the EAD and my I-140 has been approved very recently.
I would like to know if I HAVE to stick to the IT field when I change jobs or can I change fields and do anything else. I would like to go back to school also.
Is this an option or do I Have to wait for the green card.

    Thanks

If you want the 485 approved, AC21 requires the job to be same/similar in all aspects. Google for AC21 or look up on immihelp.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

So if I understand this correctly, essentially, until my 485 gets approved, I cannot go back to school if I want to?

      Thanks TX

You have to be working in a job similar to which the GC was applied for. In addition to that, you are free to go to school.

          Thanks tx.

Three separate questions wrt EAD etc.

Is there a minimum period after approval of the I-140 that I should stick with the present company?

Also, my 120 day period before EAD renewal is coming up in July. If I DO NOT renew my EAD at this time, but continue on my present H1-B, can I re-apply for the EAD at later date (after it expires?)

Also, do I HAVE to be working for a company in the IT field, or is it permissible for me to be a free lancer on my EAD?

          Thanks for all your help.

If I140 has been approved, and 485 pending for 180 days, you can use AC21. It has to be a same similar job. Free lancing is allowed if you establish a own company and the field of work is similar to your current labor filing.

              Thanks Tx.
The other thread you linked me to answered my EAD renewal question also.

So basically, I can't just work from home through e-lance or something like that. I would HAVE to register my own company?

Thanks for all your help again
