Hi,

My EAD expires around mid-Sept. I haven't filed for renewal on the hope that the green card will be released at around that time. ( My receipt date on I-485 is July 26, 2007 in Nebraska. Processing dates in Nebraska as of last month showed that they have worked on July 28, 2007 applications. I haven't received any notice yet.

Question #1: Any idea as to how long they would actually release the green card given the fact that they claim it has been processed based on the given dates?

Question #2: Are there serious implications should I decide not to renew my EAD since I am staying with the same employer anyway? My H1 is valid until 2011.

You are an optimist. Not renewing EAD hoping you will get a GC? Wow!! Just don't be so naive and go ahead and renew your EAD.

PD being current does not mean you will get a GC in that month. The DoS sets the PD cutoff date so as to use all visa available numbers. USCIS is the one that processes the cases based on the PD and also in some *****al order the applications were filed.

If DoS sets the PD Jun1 2006, that means any case before that has a "possibility" to get approved but not a given rule. Most likely, the PD could retrogress again in September if cases till Dec 2005 used up all the available numbers.

You need to know the facts before deciding on not renewing the EAD. Get your EAD if you want to work as GC is not a given when PD is current.

If you are using H1 and have not used EAD or AP, the renewal can be ignored.
