I would like to find out about starting the I-130 family based process for my spouse who is on H1_B. We have a scheduled travel that’s coming up within 4 months, and it would be hard to change that plan. Should we do it ASAP or after the travel dates.
Travel with the current H1-B comes to less then a month of H1 expiry date when we return, Would that create problems?
I read from searching here that I-131(Advance Parole) can be applied in conjunction with the I-130/I-485. I wanted to check, what's the criteria for processing I-131? are there any restrictions while I-130/I-485 is getting processed.
Any advise from your experience knowledge would be appreciated.
