Can EAD renewal be done by spouse in my absence
Hello,
I am on L2 visa with a valid EAD.
As my n my husband's Visa is getting expired in this dec, we are going back to India to issue a new one.
As my EAD is also expiring on the same date, we have planned to issue a new EAD aftr coming back to U.S.
My husband will be coming back to U.S. once our visas are done, while i'm planing to stay back in india for some more time.
My ques here is,
can my husband start my EAD process once he's back (while i'm still in india) so that we dont waste any time for getting a new EAD.
OR
My presence is necessary, i.e. copy of my new I-94 is necessary to submit the documentation.
When gone thru the documentation list needed for EAD application, it is mentioned that 1-94 is needed "if available".
Does that mean that we still go ahead and apply for renewal of my EAD while i'm back in India??
