  • Queston about EAD and H1B extension

    Hi

    My I-140 is approved and my priority is already current.

    I have applied for my H1B extension last week and I am yet to receive the receipt notice. I can apply for the I-485 along with the EAD and AP. While these are pending,
    what happens if my H1B extension is rejected? Can I still work in USA while my EAD is pending? Or do I have to leave the USA? If I can stay in USA, how long am I allowed
    to stay in USA while the EAD is pending?

    You can stay in the US until your I485 is adjudicated. You cannot work until you get your EAD.

      How long does the EAD process is taking nowadays? In the past, usually it takes about 3 to 4 months. Any ideas? I am hearing that these days, it is taking more than 6 months.

        Most reports I see are from people from marriage AOS and is taking more than 6 months for many of them. I think it all dependes on service center and person reviewing the case.

        You can check: https://egov.uscis.gov/processing-times/ for estimates.
        Nov 2018 - Package sent - EB - Texas Service Center
        Day 1 - Package received at the lockbox
        Day 999 - Card delivered to me - Aug 2021

          Minimum is 7 months for the most people.
