  • EAD For my father (what will be the eligibility category)

I am a US citizen. While my father is in the US, I filed for I485, Advance Parole and EAD for my father. I recd a rejection notice asking for EAD fees. I have read that if EAD and AP are filed along with I485 then EAD and AP fees are waived (it's free). So why is USCIS asking for EAD fees?

I am unsure of the eligibility category on I765 form as C35. Wondering if that is incorrect. Is IR5 an eligibility category? Or what is the correct eligibility category, I need to put on the EAD form?

The eligibility category for the EAD is C9 (i.e. someone with a pending I-485). Hurry and file it by March 31 -- EAD and AP will no longer be free starting April 1.

This is my personal opinion and is not to be construed as legal advice.

I filed for my father's EAD again updating the eligibility category to C9. Thank you so much!
