I have had my Advance Parole approved and the approval letter sent to me, unfortunately me and my ex husband have just recently divorced and he received the AP Letter from USCIS, he is now refusing to send it onto me as he does not want me to return to the US.
My question is... Do I have to have proof of the AP in order to return to the US? (I have a 10yr green card, my AP was to apply for 12 months outside of the US without losing my right to apply for citizenship as I do want to return to live in the US just wanted a break after the divorce)
Do I have to have the letter with me in order to return to the US or can I re-enter with my green card and other proofs of ID (passport etc). Will it be on my USCIS record that I have been approved to have these 12 months outside of the US, or must I have that letter in order to not lose my right to apply for citizenship?
If I need to physically have that letter, is there any way of getting a replacement/duplicate from USCIS or do I have to refile??
