  • Can my employer (NFP) file my Green Card if I am on OPT (17-month extension) expiring

    Hi all,

I am new to this forum. Please pardon me if my questions are dumb. First, let me commend on the initiator of this forum. It has been so helpful to many. Many thanks on behalf of all that have been helped. I wish and hope my questions will be attended to as well!

I was admitted to the US Master's program (Manufacturing Engineering) in IL in 2010. I graduated in May 2012 and I got my OPT afterwards. I got a job in September 2012 with a Not For Profit (NFP) Organization as an Engineer. My employer started participating in E-verify so that I could extend my OPT which I did and will expire in December 2014. My employer did not know what to do in order for me to stay and keep working so I had to tell them about filing a green card and they agreed. My questions:

    1. I consulted a lawyer and she told me I will have to file H1B being on OPT? Is this true? I read on this link: http://www.uscis.govhttps://www.immi...rd-through-job that my employer can file GC but did not mention your status.

    2. From now (Feb 2014) through Dec 2014, is there enough time frame for this process (GC filing)?

    3. If answer to Q1 is true, when is the best time to file H1B and do I need to let my employer know they need to file H1B instead of GC?

    4. I was featured in the newpaper in 2012, would this help my application and does my employer need to inculde this in the petition?

    5. What category would I fall into (EB2???) If yes, then I am guessing my employer would need to go through labor certification with DOL even though I am guessing they would have gone through this before employing me as a foreigner (Nigeria).

    6. My employer plans to promote me and change my title down the road. Would this affect the application or it is advised they keep me in this title till the application process is complete?

    7. My wife had been out of status since 2011, can my GC application affect her? We have a child of almost 2 years and was born here. If NO, what do you advise as I am worried about her. Immigration Reform??? - Only God knows when this will become a bill.

Your response will highly be appreciated. Thanks for your time and sorry for boring you with my story. Thanks to you all!
