    hi,

    I have been working in the capacity of a Manager since 2005. I was recruited in the current firm as an executive manager in Nov 2010. I was granted the L1-A visa in Apr 2012 and i moved to US in Sept 2012 in the capacity of a Project manager. On going through the Immihelp site, I did realize that the L1 A category is eligible for processing the Green card through EB1 C category.

    I did have a word with my manager related to the filing of Green Card since I did satisfy all the conditions mentioned here in for the filing. He said due to organization policy an employee's green card is not filed unless the employee is a critical resource or there is a business case for justifying the green card application. Leaving this point apart I also got to know that the organization files for Green Cards only in EB3 category ? Does this mean that although i have an L1-A visa and i do qualify for the EB1C category, I would need to file for the Green Card( if approved) in EB3 category only ?

    Wanted to understand if filing for green card on EB3 category is allowed by regulation for an L1-A visa holder.

      OK. so that pretty much means, that i need to file for a H1-B with another employer willing to sponsor a GC application. Is there an alternative ?

        No other option. You are and I believe were always free to leave your current company and try your luck outside.
