  • Question on I140 premium processing after EB2 movement July 2014 bulletin

I have ported EB3 to EB2 and have just filed I-140 (couple of weeks back) under normal processing. My EB3 priority date was Feb 2005. We have requested using Feb 2005 priority date with the new I-140 for EB2. Now that EB2 dates have moved to 2008, should I convert my I-140 to premium processing. According to my lawyer, since I have already filed I-485 with my EB3 (during Aug 2007), I do not have to file another I-485. And that once my I-140 is approved and visa number is available, my Green card will get granted.

Should I spend the additional $1000 and convert my I-140 from normal to premium processing?

    I would say yes.

This is my opinion not legal advice.
