Hi,
My husband has converted from L1B to L1A and has got extension until March 2018. He will not get extension after this since his total time in US on L1B + L1A will be 7 years.
However, his employer is ready to file for GC in EB2.
My queries are -
1) Since he has only until March 2018 to stay in US and if GC is filed at the earliest, will he be able to stay in US if he gets I140 before March 2018? If yes, which visa will it be on?
2) He has spent time in India from Nov 2015 until May 2016 in India after getting L1A. Can he be eligible for EB1 even without spending a year in India?
