  • EB2 filing having masters degree but working in different feild

    Hi,
I have a masters degree in electronics and 2+ years of experience in software programming. My lawyer is saying that if file EB2 application the chances of rejection are there as I don't have computer cources in the degree.
    1) will it be a problem If I file my petition under EB2.
    2) if I do premium filing of I-140 and then even say I get rejected then will this effect if I file again with EB3. Are there any impacts in later stages or citizenship application if you are rejected for this reason in I-140?
    3) currently EB3's priority date is 2003 and EB2's date is 2004 so if I file under EB3 now when can I expect to get the GC? 4-5 years?

    Appreciating quick responses.

    Thanks
    Rahul

Go with what your lawyer says. Apply for labor certification now, you should receive the labor around December 2007. Next apply for I-140 in Jan 2008 and forget about it. GC will take anywhere between 8-30 years. Apply for GC and forget abt it, concentrate on your career and buy a house in India or the US and try to pay it off completely.
