I am looking for help and suggestions on my case. Any help would be very much appreciated.
My wife visited US as B2 3 years ago, and she abused her visa by serving as "visiting observe" for a US local hospital. She did not get any payment and basically only checked out the facility and attended several seminars. She didn't know it is a violation since not familar with US immigration law. Right now she applied H4 visa twice but got rejected. Somehow the officers knows it and keep saying that she was intended to work in US during her previous visit. Right now we think it would be very difficult for her to enter US through visa application. is that true?
Meanwhile, I am going to apply green card with EB1B process and was told that she could get green card at consulate in my home country US if my I-485 got approved. My question is: Will her previous abuse of B2 visa affects her getting the green card?? What potential effects about it?
Could anybody help if knows something about it??? It is not fair to ban a people for unintentionally do something wrong, isn't it??
Any other ways besides green card??
