  • Green Card Processing

I am currently on L1 visa. I am getting a sponsorship from an employer for GC without a H1.

    1. Do I have to stay in US when our GC is processed or during any processing stages?
    2. How can I & my spouse come back to US if I do not have a vaild visa to enter US?
    3. When do we usually get an EAD?
    4. Processing fee for GC (including attorney)?

    Thank you

No you do not have to stay in USA but you will not be able to adjust status (file I-485) hence no EAD or AP needed.

You dont need H1 for GC processing, in fact since GC is for future job you dont have to be ever in USA before your GC approval. In this scenario afetr I-140 is approved the file moves to a consulate abroad and consu;ar processing takes place. When the PD is current you go to the consulate and get interviewd.stamped and enter USA and get the Green card in mail afetr your arrival here.

To come back to USA you need some kind of visa if you plan to be here before GC approval comes through.

the price varies from 5k -15k per person.
