  • How can I qualify for EB2?

    I graduated with a Masters degree in Electrical Engineering in May ’06. Since then I’ve been working for a company. The company is ready to file for my GC however in EB3 category. I’ve heard it takes a way too longer time for EB3 than EB2. I don’t have any prior industrial experiences other then what I’ve from the company willing to apply for my GC. My current position’s min requirement is Bachelor’s degree. This further creates complication making me non-eligible for EB2.
    Is there any way I can become eligible for EB2? How about if I switch to other company and ask them to file for my GC. That way I’ll be able to show 2 years of work experience from this present company. Kindly suggest.

    For EB2, the job has to qualify for the category and then comes your qualifications into picture.

    If the job does not require someone with a MS or a BS+5 years experience, there is not much that can be done.

    If your company does not support your EB2, you cannot do anything. I would suggest go through EB3 now, find an employer that can do a EB2 and port the PD from EB3 to EB2. Also note that experience from your current job in the same comapny cannot be used for GC labor.

    Overall, it is beneficial to switch in terms of GC labor.

      For EB-2, the job must require MS or higher. The PERM job description must state this requirement specifically. If the job description also states that the employer will accept BS + 5 year progressive experience "in lieu of" a Master degree, then a person with BS + 5 yrs progressive experience may qualify for an EB-2 I-140 if the PERM is approved.

      So, I think, if the job description states that a BS + 5 years progressive is required (and a MS is NOT), then the person with BS + 5yrs (but no MS) would not qualify for an EB-2 I-140 with this PERM.

      Am I correct?

        Yeah what you said is right. There's nothing much i can do right now other than looking for another job with MS as a position requirement OR go with EB3.
