  • Change Employment just before filing for I485 can cause problem?

    Hi,

Can someone clarify my question. I have filed for my Green card last June but it was returned due to various reasons and finally when I have fulfilled all the requirements, Priority dates were unavailable.

Now since Priority dates became available (April bulletin for EB2 Dec'2003) I have resubmitted same application and USCIS has accepted it. I have changed employement on March 1st before resubmitting application. Will this cause any problem for my Greencard process? Attorney is asking me to go back to old employer and work for six months. Is it necessary to do this or is it advisable? What are the implications if I did not go back to old employer. My earlier employer said if he gets any questions from USCIS he would support it.

    Appreciate your help.

    Regards,

    Madhu

If your old employer is ready to provide you an employment letter, it does not matter. Attorney is suggesting a safe approach as if your PD is current, GC could be approved anyday. Once approved, you have to go work for GC sponsoring employer for 6 months at the least. You can possibly do that now to avoid unnecessary RFEs is the reason behind attorney's suggestion.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
