    Hello. I am a canadian citizen and I work for a US contracting agency A who can place me with a number of different employers in the US, but I get paid directly through agency A, working under TN status.

    I worked for them for 2 years on a TN, and they finally applied for a H1B for me last year and it was granted to me. The TN I had active expired about 3 weeks ago and I handed it over to canadian customs when I crossed the border on my way back to Canada (as I want to be in good standing with US authorities). My H1B has not been utilized yet, it is supposedly usable anytime after October 1, 2008, and it expires in 2 years (2011). I did not use the H1B as I was under the valid TN until a few weeks ago.

    I was planning to spend my summer in Canada now, but I am looking for the next US contract job to appear through agency A, but jobs are scarce with them and I do not have a job with them right now, but I am in good standing with them. Agency A applied for Stage 1 of a GC last year and it was approved about three months ago. They asked me to sign a subsequent form and send it back to them so the could proceed with the other 2 steps of the GC.

    Can someone tell me if I can work for another employer through a TN visa without agency A finding out? Agency A knows my SSN number and I don't want them to cancel my GC application that may be in the latter stages of the process. Also, I would like to go to the US stay there with my family so that I can be more effective in looking for work from there (but I would be unemployed for several weeks until I find work and I would need to utilize the H1B to get into the US, and I don't know if the scenario of being in the US unemployed and under H1B status is OK with UCSIS). If I get another job with another employer, I could go the TN route for that, or transfer the H1B as a last resort. I was thinking if I could work for another employer in the interim until I could get a job with agency A once again after the job market improves and not have Agency A find out, or ruin the GC process that they are doing for me.
