  • Marriage after visa is issued/interview

I have an active E-3 visa application and is waiting for my interview schedule. My girlfriend and I are planning to get married within the year but currently, she is still working outside our home country. She will be finishing her contract soon and will be returning thereafter. There might be a tendency that I will be scheduled for interview prior to her return. Would she still qualify to apply for an immigrant visa as my spouse if we get married after my interview but before my deployment in the US? Is it absolutely necessary that we should get married prior to my interview? Or would it be still okay if our marriage would occur after my interview.

    Thank you.

She will qualify for an immigrant visa as your spouse even if you get married after your interview. Either way she still have to file an application for Marriage I-130 and Adjustment of status too I-485. That will take an extra year or two to do.
