EB1 using H1B

Hi,

I moved to US in 2012 on H1B visa through same company that I was working in India. My US entity filed my GC in EB2 on 2014. But, I was eligible for EB1 at that time since I was at managerial position in India before mining to US. Since, it was not norm to file EB1 in my company at that time, I was not too concerned.

Now looking at immigration mess, i am planning to work with my employer to file in EB1. Is it possible to file in EB1 when my I_140 is already approved in EB2? Is there complication in my case?

You can have as many immigration petitions on your name as you want. Each petition is independent of others.
