GC in EB1C after 5 years

  • GC in EB1C after 5 years


    1. I worked as a senior Manager in India from 2009 to 2014 for US based company "A".
    2. I moved on H1b to company B in 2014.
    3. I joined back to company "A" in US on H1b in 2015.
    4. Company "A" now wants to file GC.

    According to UCICS site:
    You must have been employed outside the United States in the 3 years preceding the petition for at least 1 year by a firm or corporation and you must be seeking to enter the United States to continue service to that firm or organization

    Am I eligible for EB1C? Can anyone please help.

    The 3 yrs. prior are usually counted from the entry to the i.e., say you entered the US on L1A, got extensions and in your 7th and final year after the entry are filing I140in, you still are eligible for EB1C consideration. Hence, you too would be eligible.

      From 2012 to 14, if you have worked for company A, you will be eligible..
