My employer encountered some problems before filing a prevailing wage determination for my green card. I would like to have a better understanding of the issue before talking to my employer and attorney:
1. If my position is covered by a collective bargaining agreement, does the employer need to provide a current contract and a support letter from the union confirming the position and salary minimum?
2. If the answer to Q1 is Yes, what should we do if the contract has been expiring for more than 1 year? We do not know when the new contract will be finalized. Does it mean we have to wait till the new contract is finalized to submit a prevailing wage determination request? I wonder whether other people have encountered the same problem before and what's your suggestion?
