    Hi,

    I am a H1B holder and in my second 3 year term. The current visa expires by Jun 2011. But I came to US only by Feb 2007 and got the extension on Nov 2008. My question is could I get a extension after Jun 2011?
    Next question is since I have only few year in my H1B I have planned to do my GC. My company A is fooling me from past two years saying they will file my GC and now they have once again asked my documents to file GC on March 2010.

    Till now I haven't got back from them about how the process is going. I to have few issues with this company A and overall it seems company A has a bad name. Now if they apply for my GC will it force me to be with this company A till I get my GC?

    If you are this is situation what will you do?

    First of all forget the fact that you will ever get your GC because there is too much backlog. The only way you can get an extension after Jun 2011 is to have your GC process started on or before May 2010. Only when your GC process is pending more than 365 days, only then can you get a 3 year extension on your H1b. The other solution is not starting the GC process, moving back to your home country in June 2011, work two years there and then come back with a fresh H1 through a bigger, better company. If you are in real bad terms with your company, the second approach is better.
