L1A 4 years in USA 140 to be filed in Nov/Dec 2020

  • L1A 4 years in USA 140 to be filed in Nov/Dec 2020

    Hi All,

    Need suggestions.
    I came to USA on L1A in Dec 2016.Almost 4 years now.My employer has promised me to file GC application in Dec 2020.
    I saw the priority dates :https://www.uscis.gov/green-card/gre...isas-july-2020.

    It shows May 2017.That means I am too late.
    How do I proceed?

        Ok. I get your question now. Regarding the PD movement, its anybody's guess. Infact due to the COVID situation and the recent immigration visa issuance halt, EB1 PDs are expected to move faster. In any case, that a bridge you can cross when you come to it. First things first I140 application and approval. Your employer can always file for a H1. If approved, you can shift to H1 and get unlimited extensions until your PD becomes current.

          Thanks a lot! Assuming I wont get H1
          1.So if I apply for AOS (when my PD becomes applicable), I can also apply for EAD? Or We have to complete everything before 7 years max out?
          2.Worst case, I can go back to my home country and get consular processing whenever PM becomes applicable?

            1. Yes. Yes you can apply for EAD. You only need EAD to keep working (not the actual GC). So if you can get that prior to your current L1A expiry, you are good.
