EB1 eligibility

Hi,

I initially entered US for work on a L1B visa back in 2005. After that I have been going to an fro between US and India up until the recent past. The last time I returned to India in 2006, I played a managerial role in a project for about 11 months.

Since the 5yr limit was coming to an end in L1B category, I recently applied for a change of category to L1A and my petition has been approved.

I would like to understand if I am now eligible to apply for permanant residency under the EB1 category. Please clarify.

Yes, you can apply for EB1-C category since the criteria for EB1-C and L1A are same (multinational executive/manager). You will need to show that prior to the posting in US you were designated as a manager in your native country with specific authority (hire/fire, appraisal etc)

I was also on the same boat. My 140 is approved and have applied for AOS.
