  • Time for L1-A under EBIC to GC

    Hello All,

I've received my L1-A visa earlier this year but haven't been able to travel due to Presidential Proclamation. My firm has started the process of NIE which should help in travel later this year hopefully. My query is this:

    1) My employer said that L1-A under EB1C has a better & faster route to GC. Your thoughts and experiences on this please.
    2) What has been the latest experiences of anyone of you on processing GC from L1-A?
    3) A colleague who's already in US said that he converted his L1-B to H1B so that he can have extended visa approval once his I-140 is received? Your thoughts?

I'm already being offered few roles in India and would like to be sure of moving with my family & kids to US. Your clarifications would be really very helpful.

Please don't take it as a legal advice but some thoughts based on my experience so far. I am on L1A and applied for EB1C.

    1) My employer said that L1-A under EB1C has a better & faster route to GC. Your thoughts and experiences on this please.
As of now, EB1C processing might be anywhere between 1.5-3 years. This is faster compared to waiting time in EB2 or 3.

    2) What has been the latest experiences of anyone of you on processing GC from L1-A?
I am in the same boat. Concurrently filed EB1-C in May, biometrics completed and waiting for I-140 approval. Before filing, my attorney tried to scare me enough about rejection rates in EB1C. But I still decided to go with EB1C. I am already 45 and I don't think i will wait for 20-30 years to get GC.

    3) A colleague who's already in US said that he converted his L1-B to H1B so that he can have extended visa approval once his I-140 is received? Your thoughts?
I can't advise you for your specific situation. If your final goal is to get the GC and you are already on L1A it becomes easier to justify your case for EB1C. Even though rejection rates are high (my lawyer told me 50%), you can try your luck.
