Hi,
Here is my case,
My H1B is expiring Jun 28, 2011.
I had applied for PERM (EB2) in Nov 2008, audit in Aug 2008. Finally denied in Jan 2011.
Applied 2nd PERM (EB2) with the same employer in Feb 9, 2011, unfortunately audited on Feb 25, 2011. Audit cases usually takes 2 year for approval/denial.
Give the following situation:
1. Is it possible to get the 7th year extension?
2. I went to India last yr for 4 weeks, can I recapture those?
3. Can I apply for EB3 with the same employer while EB2 is been audited?
4. Is there any other option for getting extension beyond Jun 28, 2011?
Please help!! Any help will be appreciated.
