  • Porting from Eb3 in company A to eb2 in company B and h1 extension

Hi I have a few questions regarding the Green Card process, H1B and what implications it has in my particular case and would highly appreciate if someone knows the answers and can share the info on it.

Firstly, here are some of the details on my current situation.

My first H1B was approved for 10/1/2004 to 9/30/2007 while i was working with Company A in phoenix, AZ.
Subsequently, the H1 was extended from 9/30/2007 to 9/29/2010 again with Company A (PHX, AZ).
In the meantime, I had done the Labor Certification, I-140 application with Company A (phx,az) and the I-140 was approved on 01/25/2009 with a priority date of 06/11/2007.
Because of the I-140 being approved my H1 was extended again in 2010 from 9/30/2010 to 9/30/2013, again with Company A.

Now, in march of 2012 when i moved to Company B (San Jose, CA), my H1 was transferred and approved for 03/19/2012 to 09/30/2014.

    Here are my questions.

    Related to H1B
    1. The latest H1B VISA on my passport is for Company A and expiring in 09/30/2013. When i Travel next to India will I need to take an appointment with the consular office in india and need to get another H1B VISA stamped ?

    Related to Green Card.:
    2. Will the Green Card processing with Company B be a completely fresh application or can i port over any of the steps completed by Green Card application filed by Company A ?

Related to both Green Card and H1B:

    3. My next H1 renewal should come due in 2014. I have long used up the 6 years of extension, so if i understand it right, I need to have I-140 approved (to get a H1B renewal of 3 years) or have I-140 filed atleast 365 days before the renewal application (to get an H1B renewal of 1 year). If my understanding is right, and going by current processing times, Do i have sufficient time on hand to be eligible for H1B extension in 2014 ?

    Regards,
    Vishal
