  • Vias Interview and a query about "Seek to Acquire"

    My visa week is here !!
    Are there any prequations to take?
    Clothing and stuff?
    I hope my CSPA is approved. Good luck to me
    I just read that the child has to seek to acquire within one year of visa becaming available. Reading more into it got me confused more. Can anyone explain it to me in layman terms without the fancy words ?

    Dw.. U'll sure get visa.. One ofmy cousin got visa last week heis 28 yeRs old but still got benefit of cspa

      I am apparently covered under cspa but still with usa you can never be sure :|
      You have any idea regarding seek to acquire? I m kind of confused.

        Seek to acquire in one year mean after visa become available for ur family u'll have to get green card with thin one year..! If u wont able to do that then u'll have to leave usa.. N there is a law for cspa so we can be sure for that..! It's not like we cant say anything for usa so they strictly follow the law..n cspa must apply in any case if child over 21 and still unmarried..! N there are two parts too.. If u aren't eligible under cspa part one then part 2 apply to u n in part 2 ur parents will have to file foru after they reached usa n get their green card which would around after 1 month .after submit that file ur pd will be same which is rightnow n u'll get visa soon..!

          I had no idea about the part in which we can retain our old PD. Is there anywhere where i can read it up?
          Also I am in college right now and i cant be on leave for long so if i go there and stay for 10-15 days and come back, can i file for my greencard in that much period? My studies get over in may 2014 and then there is 1 year of internship after that. (MBBS SUCKS!)

            L1A visa expiring in 2014

            My L1 visa is getting expired in April 2014.I need to travel India in December . Can I travel .I will be filing for extension in Jan 2014 beginning .Can someone tell me is it OK if I travel in December or will I get any issue in poe?

              No u'll have to stay there till u get green card ..!n yes u can read whole cspa on uscis website .. Goodluck buddy n dont worry..! Everything will be good

                I have heard ppl coming back after a week or so after entering USA as green card takes few months to come. I can't stay in USA as that would mean wasting a year of my college and that's not possible :// and thanks !!

                    Some of you guys are confused

                    I'm going to explain a few things. Hopefully the laws haven't changed since the last time I read immigration info.

                    1) 'Seek to acquire' in this sense means that the 'child' has up to 1 year since the visa bulletin said that their priority date(PD) was current to 'attempt' to get their immigrant visa/greencard. THIS DOSEN'T MEAN YOU HAVE ONLY 1 YR TO RESOLVE YOUR PROBLEM. If you make this time frame pass WITHOUT TRYING to do anything at all then you're out of luck.

                    2) For interviews the dress code is business casual. Search Google images to have an idea.

                    3) Ensure that you have the docs the interview letter outlined, a pen and review the list of things your are allowed and not allowed to bring to the embassy/consulate.

                    4) I don't think you retain your family's original PD if you are left behind. You don't get covered by CSPA then you get a new PD if your family files for you.

                    5) When you get your visa you usually have up to 6 months to enter the US (check to make sure). Once you enter the US apply for a re-entry permit. This document, once approved, allows you to be outside the US for up to 2 years without your greencard status being in jeopardy. You can apply for it as soon as you step foot in the US. Read up on that.

                    6) At the Point of entry(POE) you get a stamp in your passport that acts as a temporary greencard. However it expires after 1 year. So technically you can re-enter the US if you have that stamp in your passport. Read up and or call the necessary authorities (like airport officials) to make sure.

                      Understood the 1,2,3,4.

                      5) I read about it few months back. Kind of forgot about it. I think i will have to apply for that as soon as i enter USA ie if my CSPA is approved :| . I have my college going on, i m in med school and on an extremely tight schedule and a 2 year re-entry permit would actually help me a lot.
                      6)Yeah i read about it. Some places state that greencard is mailed to you by the authorites automatically once this is done. So technically once i have the stamp on passport i can return to my country and my parents who will be staying back will receive my greencard within few weeks/months?
                      My main concern is CSPA and then having to stay in usa on my first trip especially when i am going to have my final term exams :|

                        6a) Once you pay the immigrant fee you'll get it in the mail (the time for delivery varies though).
                        6b) Yes to everything else. But you can't be outside the country for too long if you don't have a re-entry permit or a returning resident visa (not your concern if you have a re-entry permit).

                          Thanks again for the response.
                          I am planning to go for expedited re-entry permit application once i reach there. Talked to my parents about it and they told me that they will discuss once the visa is granted. Its just around 36 hours now!!!
                          I am hoping for the best. I believe they should solve the CSPA calculation prior to interviews,it decreases the stress greatly.
                          Anyone around here who has given interview at the Mumbai Consulate,is there any waitng area or something like that? I would need to wait somewhere untill my parents go inside and the interview is conducted. Also if my CSPA is approved can the CO call me inside and let me interview with my parents? My medical is left but my iv fees and ds230 has been submitted.
