  • Getting married after I-130 is filled

    Hi,

My sister will soon become a US citizen and she intends to file an I-130 for me to get a green card. However, i am currently not married but plan to marry my partner(defacto) in the next couple of years.

I understand we can adjust the application after it's filed, but I'm worried that:
    - it will delay the application
    - it may be approved super quickly and I will get green card but not my partner

Should I rush the wedding? Delay the filling? File and change the application later?

    Thanks for your advice.

If your U.S. citizen sister files an I-130 for you, a quota-based visa slot won't be available for you for 10-20 years (depending on which country you reside).

It doesn't matter if you marry after she submits the petition or not, as "marriage status" is not an issue with this petition type.
