  • Checklist from NVC.

    Hello, I am an American citizen, and one year ago a married an Italian woman who was in the US on the Visa Waiver Program. She returned to italy before the 90 days waiver expired. We then began the I-130 (cr-1) petition with the USCIS. We have made it through that whole process and now our case is in the final phases in the NVC. This is where our first problems (other than the long wait) have come up. I have recieved a checklist from them regarding my affadavit of support forms. I am unemployed, and have been for some years, so I had to use my mother as a co-sponsor to meet the income requirements.I included the required letter stating that I have not filed taxes because of unemployment exemptions. But on the checklist they have stated they need my 2012 tax return as well as other income information that simply doesnt exist. There or some other checked items as well but I think I can provide that information. What im confused about is do I have to redo all the I-864 packet with the corrected info, including all my mothers tax transcripts and income info? Or do I just send in the missing items, Really not sure how to go about responding to the checklists. Any information will be greatly appreciated, at this point were so close to the interview being scheduled but are stumped at the moment. Here is a copy of the checked items on the checklist.

    For me the checked items include:

    I-864, Affidavit of Support Checklist
    [x] The Affidavit of Support is an important legal contract between you and the U.S. government. During our review, we identified one or more sections that were either incomplete or contained incorrect information. Please review the additional instructions below then complete and submit a new Affidavit of Support. You can download the I-864 form and instructions at http://www.uscis.gov/i-864.

    In Part 3, Information on the Immigrant(s) You are sponsoring, please correct the following...
    [x] Item 7. The total number of immigrants listed in Item 7 must equal the number of immigrants listed in Part 3, Items 1 through 6.f. In addition, you must also verify that the total number of immigrants listed in Item 7 matches the number you entered in Part 5 Item1.

    In Part 6. Sponsor's Income and Employment, please correct the following...
    [x] Item 10. The current annual household income must equal the sum of items 5, 6.c., 7.c., 8.c., and 9.c. [x] Item 13.a. You must include your _____2012______ tax and income information. [x] Items 13.a.1. The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead.

    For my Mother the checked Items include:

    You must submit the following financial evidence:
    [x] Proof of U.S. citizenship, nationality, or Lawful Permanent Resident status (examples: a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to citizen parents, or a copy of the biographic data page of your U.S. passport).

    [x] Proof of current employment (examples: a recently dated job letter, pay stub, or a copy of your business license).

    You need to submit a new I-864 and follow carefully the items checked which must add up or be completed. Your immigrant number (1) must be carried forward. If you have no income show "0" for income and leave the tax return area alone.

    For your mother, you must include proof of her citizenship or legal status (U.S. birth cert or U.S. passport ID page or Green Card copy. You must also provide an employment verification letter for her if she is a W2 employee.

      Ok, so I redo the entire packet with the corrected items. I have my mothers birth certificate and a current paystub showing proof of employment. Im confused that one of the checked items is for my 2012 tax return, even though I included a letter stating I was unemployed and did not have to file. Also, they said we didnt meet the income qualifications. My mother is co sponsoring and she falls $600 short of the income qualifications. She owns her house and we included a tax assesment of the realestate and a current market analysis of the home. They still said we didnt meet the guidlines, which makes me think they aren't counting the assets. What can I do?
