    Greetings -

    I am a natural-born US citizen. I married a Japanese woman four weeks ago. She has been in the US continuously for about twelve years - first as a student, and (for the past several years) on H-1B status. Her entry visa expired long ago, and she does not currently have a green card, so she has not been back to Japan for a long time.

    We are preparing to file a whole mountain of forms (485, 130, etc.). We would like to travel back to Japan next spring, so we also plan to file the I-131, Application For Travel Document. After review last night we got confused on one point, which is this:

    When does her "conditional permanent resident" status begin?

    Does it begin:

    A) the day we got married?

    B) the day USCIS acknowledges receipt of our forms?

    C) the day USCIS finally reviews and approves our forms?

    D) ?????

    The I-131 has a few different categories in the "who is eligible to file" list, and depending on what category she is in, she will be required to provide different supporting documents. So it's important to know whether she is currently a conditional permanent resident or not.

    Your wife is a conditional permanent resident only when her application to adjust status (I-485) is approved.
