RFE after marriage based 485 interview,any suggestion will be greatly appreciated

  • RFE after marriage based 485 interview,any suggestion will be greatly appreciated

    We went to the interview on the mid of Feb at around 2:30pm at downtown LA. The interview isnt that easy but was smooth. the IO asked all the 485 questions with all the No answers. She wasnt smiling during the whole time and was very strict. Then she didnt ask us any questions like how we met just simply handed us 2 paper with questions on it(no talk), which are stuff like these general questions like when where we met, which side of the bed we slept,what did you do last weekend. However, me and my wife didnt answer the same thing for the weekend question. I said things we did in the evening and she said other things we did in the afternoon. That might be a discrepancy for the paper test. And later she asked the evidence and i showed all the utility bills and marriage photos and normal life pics. She said everything looked good then asked my lease and my wife's parents idea. replied that she has a bad credit so i didnt bring the lease cuz her name wasnt on it. Then IO said she need to see the lease regardless. Also asked us to show parent pics with us and replied my parents arent in US and my wife didnt get along with hers. So the IO asked a testimony from my wife's brother. Then said the interview is over we need mail the lease and testimony from her brother and along with all the bills and photos. RFE is on the status the day i went back home.

    It is pretty easy to prepare though, mailed all of the required evidence and delivered the next week. So far almost 60 days passed, still no news or updates received. Anyone had this experience before? My marriage is 100% real its just we are all young and have no work. I was on F1 and she is citizen. married for one year now. I am scared of having second interview or is there any chance of being denied? Anyone's idea will be greatly appreciated. Thank you so much for reading.

    If you send back the evidence requested, there is no reason to expect an outright denial. The worst that can usually happen is a second interview. It sounds as if the "interview culture" at the downtown L.A. office is pretty rigid and the interviewer may have been under pressure to complete so many interviews in the day.

    Each office, although following same evidence rules, has its own way of doing things, and individual interviewers can be real obnoxious and demanding. The worse experiences I hear of are in Reno, Nevada. Absolute Gestapos interviewing there (at least for several feedback reports I have heard in last couple of years).

    Northern California, especially Sacramento and San Francisco, are fairly relaxed.

    I spent some time in the L.A. INS offices back in the 1970's, and they were busy as heck then.

      Hi Ray,thank you so much for the feedback. It is right LA officers are so rigid and obnoxious. Our interview took like 20 mins and she didnt say anything in the end just ask us to return the evidence and wait. What my concern is it has been almost 60 days since the interview 50 days after submitting the evidence. How long does it usually take to receive a second fraud interview notice? I am thinking they fight forget our case. Info pass is the right way to proceed?

        Ian,

        FWIW, Green Card deliveries are taking 3 months and more, lately. So the lack of a response to your RFE is not that unusual, assuming all is well and Green Card production is the reason for the delay.

        Maybe 30 more days, and if not answer, an INFOPASS would be appropriate.

        In what part of L.A. are you? It's my home town, but we are in Northern California now.

          Good to know ray Im in the Pasadena area. Crossing my finger not to have a second interview since its 50 days past. I am assuming it wouldnt take them 50 days to schedule a second interview. BTW a info pass doesnt require a couple to go in together? I can go info pass alone?

            Yes, the INFOPASS can be attended by only the principal.
