  • I130 plzzz help in a dilemma

    Hey i am new to this forum. My f4 petition was filed on 13th sept 2002. We are 4 members each in 3 families. One of our family uncle got his approval letter regarding to pay $88 for AOS fees. I am thinking as to when will we receive our approval letter for the same.
    I have applied for canada student visa and will be getting a reply from them in the end of this month. So m asking what to do, should i wait for the approval letter from US?
    Please help guys, its confusing like hell.

    It depends on your country and your Priority Date. Priority Dates of Sept 2002 are not reachable yet for any country for F4 visas. But the NVC letters are sometimes sent out several months in advance.

    Whether you go for the Canada student visa or wait for the U.S. visa slot is a trick question Why not go to Canada, then if your U.S. visa slot becomes current, use that if you are ready to leave Canada.

      So what do you suggest, i should go for canada, because no one can tell when will we receive our AOS letter, i cant just sit back.

        When your NVC letter arrives depends on when your Priority Date becomes current. Without knowing which country you are from, it's not possible to tell you when your Priority Date will be current. At the very least, however, it will be 14 months before your Priority Date is eligible for visa processing, maybe longer.

        My suggestion was for you to take advantage of the Canadian student visa in the meantime, rather than sitting on a log waiting for your ticket to the U.S.

                From where are you getting Jan 2002? I am looking at the September State Dept Visa bulletin, and "22Jul01" is the Priority Date shown for F4 class cases nwo being available for visa processing. In the last few months there has been retrogression of several visa classes, so you are probably looking at an earlier Visa Bulletin.

                        After miss-citing the Priority Date info all day, I've got enough "pie in my face" to try and give you a more conservative response.

                        I think you should expect the same bill your uncle got in the near future if your petitions had the same Priority Date.

                        Allow a couple more weeks for it to show up before making up your mind which direction to go.
