    Hello,

    My mother in law has been married with my father in law since almost 40 years, he became US citizen a year ago and finally she wants to move to US to live, she has a valid B1/B2 for the next 5 years.

    The question would be if she can come to the US and process the green card from here without going through K3 consular procesing, I know for a fact I94 can last for 6 months but I don' know t if can affect or not.

    I would appreciate any help on the topic

    There is no K3 visa anymore (at least none that are actively processed by USCIS).

    Your father can apply for an IR-1 spousal visa with form I-130. If mom can arrive here on a visitor visa, and dad later decides to apply for her Green Card, her I-94 has no particular bearing on her Green Card processing, except it is proof of her legal entry to the U.S.
