    Hello

I am Canadian and I met my husband while I was working in the states. I was
on a temporary training visa and we started dating and doing long distance.
He came to Canada and proposed to me after 7 months of dating. We decided to
take a vacation together to visit his parents and to spend some quality time
with one another. We were turned away at the border because of immigration
intent, but I was able to give enough proof of ties to Canada that they
allowed me to have a B2 visitors visa. The border crossing guard told us
that we were better off getting married and that it would be a lot quicker
for us to live together in the same country. So we did about a month and
a half later. Now I am back in canada for work but I plan on returning again
to the states and will be wanting to apply for adjustment of status for my
green card so that we can start living together. But my B2 visa expires on January 5th
and i don't want to run into any troubles if I stay beyond that. What are my
options? I don't want to be separated from my husband while filing the
forms. But I am worried that I will be under the Preconceived intent or
immigrant intent when I travel back over.
I also know as a Canadian I am allowed to be in the states up to a 182 days in a 12 month period and if I count the two months I worked I've been there for four. Does the time worked count towards the 6 months.

    Thank you

I am in a situation a little like yours, but they told us that after marrying, I should stay in the US until all the paperwork is done and then I could go back to visit my family in Mexico. I have read that after you file your papers for AOS while being in the US you get a protected mode, there will be no overstay even if your I-94 date for living the country comes.

I hope this answer was useful to you.
