    *Family Third Preference (F3): Married sons and daughters of U.S. citizens, and their spouses and minor children.
    *IR-5: Parent of a U.S. Citizen who is at least 21 years old.

    Hi All,
    My Grandfather filled a Petition in Aug 2006 for my Mother and we received I-797,Notice of action approval in Nov 2010.Now we are Waiting, Waiting....Waiting!!!

    But now my sister had become US Citizen so we were thinking to change the case category since F3 is taking longer and IR-5 will be quicker.

    Anyone knows anything about this transfer? Or anyone had already contacted Immigration department for any inquiry? Any legal advice for any lawyer?

    Please share your case or any inform will be really helpful.

    Categories of visa types routinely change with citizenship or marriage occurring during waiting or processing.

    But changing visa category with a change of petitioner (father to sibling) is not likely to happen.

    It makes more sense for your sister to just petition her mom for an "immediate priority" category and completed proessing in 9-12 months.
