  • Doubts about migrating from Colombia to the US

    Hi everyone!

My family (father, mother and sister) are planning to move to the US, we all already have a tourist Visa for 10 years and my aunt is an US Citizen since 2 years ago. I read that is possible to my aunt to request my father as US Citizen and extend the request for my mother, my sister and me, is this true?

I know the I 130 petition takes between 9 to 13 years to complete for a Colombian person, but I don't know if there's a way to move to the US legally until the I 130 petition is complete and be able to start working, buy a house, a car, etc

U.S. CITIZENSHIP CANNOT BE EXTENDED TO ANYONE. IMMIGRANTS MUST FIRST HAVE GREEN CARDS FOR 5 YEARS TO BE ELIGIBLE TO APPLY FOR U.S. CITIZENSHIP (NATURALIZATION).

PROCESING TIME FOR AN I-130 PETITION DEPENDS ON THE RELATIONSHIP BETWEEN PETITIONER AND BENEFICIARY. IF YOUR AUNT PETITIONS YOUR FATHER (HER BROTHER), IT WILL TAKE ABOUT 13 YEARS FOR A VISA SLOT TO BE AVAILABLE TO YOUR FATHER. HIS WIFE WOULD BE ELIGIBLE FOR A DERIVATIVE VISA. THE CHILDREN MUST BE UNDER 21 WHEN THE PRIORITY DATE BECOMES CURRENT TO BE ELIGIBLE FOR DERIVATIVE VISAS.

Thanks for your reply, I really appreciate any help!

Well so, I'm above 21 years old so I think I'm not eligible for a derivate visa, only my sister would be eligible.

Isn't there a way to stay legally in USA and working legally while the process time ends?
