Entering US on Tourist Visa

Did you file the I-130 and the I-485 before their visa's expired? As far as I'm aware, as long as you file before the visa expires the application will be processed as normal. I also believe that you will be notified as to whether you need to file additional forms, including that where a penalty is attached.
But then I think it also depends on the type of entry visa and also the country of origin, so don't quote me anything.

i agree and i don't see any reason of denial even if they over stay that shouldn't be a problem. and if you need more information or have any more question call the USCIS. Good luck
