  • i-130 Question

    I file a I-130 for my Step Child on 8/31. and she give birth to her daughter on 10/08.. what I need to do so she can bring she child with her to the USA. Please Help I'M A US CITIZEN

    Marcos, I replied on a different thread for you.

    You will need to file a new I-130 petition for the new born.

      The grandparent has no petitionable relationship with a grandchild. His daughter will have to petition her newborn after she arrives in the U.S.

        I guess easy way will be that you write a letter to USCIS about the current situation and request them to amend the original I-130 petition and add the new born child's name in application. So the child can come with the mother to US.When you send the request you should send photo copy of the new Born's birth certificate also.

          If the beneficiary (stepdaughter) is "immediate priority," the new child will not be eligible for a derivative visa and could not be included on the I-130 petition for the stepdaughter.

          Also, any attempt to have DHS to accept an amendment to the petition will be ignored.

          If the stepdaughter is being processed as an adult daughter, the child can be added during the National Visa Center processing for a derivative visa.
