Hi! My aunt petitioned my Father and our petition is now approved so I am carried by my father's petition. But I have a son now before our petition is approved. Is it possible that we can migrate in US together with my son? Is there any possible way if I am his only parent now? We have the same surname in his birth certificate. Thanks!

If your son is under age 21 and not married, your son is eligible for a derivative visa to accompany you to the U.S.

Your son is eligible for a derivative visa, to accompany you or to follow, but you must report his birth to the NVC, get his passport, and be prepared to pay his visa fee.
