  • Domicile and W2 filling problem

    Hi all
    Am new to this forum posting but have been regularly reading the posts and must say the senior members really help others and advice appropriately. NVC has sent us the letter of document approval and says will fix an appointment soon. its been 20 days now but haven't heard from them yet. hope to hear soon. My concern is my father in law who is US citizen had sponsored us in aug 2005 and we got our letter in sept 2016.
    1. however the letter received from NVC recently confirming the appointment says that since my father in law moved from US to india to stay with us since he was old and couldnot stay alone he has not filled any IRS and no W2 forms. NVC has asked us to provide us with a valid reason for not filling tax and not providing the W2 form.
    2. Also do you recommend that I hire a lawyer for this.
    3. Our affidavit of support is given by my sis in law who is a green card holder and staying in US.
    PLease advise how do I tackle this problem.

    You don't need to pay an attorney to do the following:

    1. Father must provide a completed I-864 with a letter of explanation for not filing an income tax return, and showing no income.
    2. Sister is a co-sponsor, so she must provide a sponsorship package, include proof of her U.S. status.

      Since your father moved to India and has since retired he has no need to file a tax return unless he is drawing a Social Security benefit.
      Let NVC know that he has since retired and draws no income/No tax return.

        Hi all
        I m from Mumbai India.My father is a U.S citizen. He has legally worked in U.S for 10 years. He has applied for my immigration visa in the year 2006 July. Currently he is residing in India due to his health issues as he cannot stay there alone. After his retirement he is not paying his taxes nor does he own any house/property in U.S.
        My question is.How do we show the government the proof that he is the domicile of the country. I also have immediate relatives who are U.S citizens they will help us as joint sponsor for Affidavit of support.

        Is it important for my father to be in U.S when the file goes through final processing.If yes is there any number of days or weeks he should have arrived in the U.S before visa interview. Will this affect my visa process.Can they reject my visa due to these reasons.
        And another thing as my date is July 2006 any idea how much time it will take for my date to be current.
        I m a bit confused about all these things. It will be really help if any senior members clears my doubts. So I can make the arrangements accordingly.

          Hello deep4shah, since your father is a USC he should have a US Passport/Certificate of Naturalization for proof of USC. Since your father has retired and not worked in the US for the required 40 quarters to be eligible to draw retirement benefit theres no need to file with IRS.
          Since he is a USC he does not need to reside in the States for your GC purposes, may I ask are you doing a consular AOS/Visa?

            His father is the sponsor of OP's immigrant visa, therefore has to purport to be domiciled in the United States

              Am waiting for NVC to schedule the interview for us. but it is taking long. will keep u all updated about this.
              Since NVC has asked us to give a written explainantion about why father in law has not filed the taxes we are just taking a written letter in dads handwriting the reason. hope all goes well

                No I am not doing a Consular AOS/Visa. Do I need to??
                Also when my father applied,only me and my wife's name were included in the form. After which I have 2 sons. I haven't added their names yet. Do I need to add my children's name in the form and how?? Is there any other procedure I need to follow. Pls help.
