  • CR1 - Affidavit of support question

    Some info about me:

    I'm a US Citizen living in the Dominican Republic, I've been living here since 2008. I got married in July 2016 and we intend to move to the US. Since neither of us live in the US, we are going to move with my sister and her boyfriend. Also, I've never reported taxes in the US, because I've never worked there and my income here is below the minimum required to report.

    Our process has gone pretty well so far. Our submission was approved by the USCIS, and we have our dates to go to the VAC and the Consulate. Right now we're filling the form I-864 Affidavit of Support, and it's by far the most difficult we've filled. Since my income don't meet the minimum required, our friend (my sister's boyfriend) will be our joint sponsor. We already have his tax return transcripts and he is filling the form. My question is, because we are moving together to the US, neither of us will have a guaranteed income (we'll be unemployed), do I need to fill something different? Or does it affects in any way the affidavit?, Do I need to be filled as dependant of the joint sponsor?

    The joint sponsor's household size on the joint sponsor's I-864 would be their usual household size + 1 for the immigrant. You are not counted.

    For your own I-864, you will count your household including the immigrant. The joint sponsor is not counted. You will put 0 for your current income and put N/A for the "total income" for your tax returns from the last 3 years, and attach an explanation for why you weren't required to file for those years.
