Hi - I am filing my parents GC and have questions. I searched on forums but i am still not clear on the process.
Here is my situation
Parents age > 60
Both parents in US on B2 VISA
Here is what i gathered online, discussions with friends who when through process and online - Please correct me if i am missing any form or wrong
Application Packet should have -
Sponsor cover letter - Couldn't find a format online
i130 - Petition for Alien Relative - A separate application need to be files for each beneficiary.
Beneficiary Cover letter - Couldn't find a format online
i485 - Application for adjust of status - A separate application need to be files for each beneficiary.
i693 - Report of Medical Exam - A separate application need to be files for each beneficiary.
G325A - Bio Graphic Information - A separate application need to be files for each beneficiary.
i765 - Application of Employment Authorization - A separate application need to be files for each beneficiary.
i131 - Application for travel documents - A separate application need to be files for each beneficiary.
i864 - Affidavit of Support under section 213A- Need 2 copies or one ??
Applicable fees - Below i have listed - i130 - $535, i485 - 1140 and Biom- $85 - per applicant
Questions on process
Since both parents will be applying at the same time - Can we send both members applications in 1 package ? or Do we need to send them in separate packages ?
Questions on application
1) i130 - What should be the beneficiary address in section C ? - overseas or US address where they are residing now
2) i864 - Part 3 has list of family members sponsoring - Should you make 2 copies of the same form and file with each application package?
3) i864 - Part 6 - Income - If you are filing returns jointly with your spouse - Should spouse fill I864A even when your individual income is enough to support the beneficiaries ?
4) i485 - Part 1 - Should we provide the US address where the applicant reside in US on B2 Visa or Should this be permanent overseas address ?
5) i693 - Part 1 - Should we provide the US address where the applicant reside in US on B2 Visa or Should this be permanent overseas address ?
6) i765 - Part 1 - Should we provide the US address where the applicant reside in US on B2 Visa or Should this be permanent overseas address ?
7) i131 - Part 1 - Should we provide the US address where the applicant reside in US on B2 Visa or Should this be permanent overseas address ?
8) G325A - Applicants address for last five years - Parents travel a lot - 6 visits to US and 6 visits to UK in last 5 years - Ranging between 3 month to 6 months - Should we list all address or since they were just visiting, we should write just there permanent overseas address ?
Questions on application fees
From the latest fee schedule, this is what i gathered per applicant - Can anyone confirm that this is true for 2017
i485 - $ 1140.00
i130 - $ 535.00
i765 - No fee since filing concurrently
i131 - No fee since filing concurrently
Bio Metrics - $ 85.00
missing any other fees ??
Questions on supporting documents
1) Marriage certificate - Their marriage was < 1975. They never needed a marriage certificate in home country since they have spouses names on passports. Getting a marriage certificate now is not possible. Will affidavits from grand parents (one each alive) and witnesses be enough as supporting documents to passport copies.
2) Birth Certificates - Parents were both < 1960 when there was no legal requirement for registrations and they never needed one. Will a letter from consulate certifying the birth as per passport with additional witness affidavits enough
3) Sponsors birth certificate - My birth certificate just has by Dad given name. Getting a new one is not possible. Will it be a problem for Mom since we don't have Marriage Certificate.
I am sorry with all the questions but i have seen may applicants have same or similar question and the answers/advise was not clear. Once I file my parents GC - I will document the process, any advise given and publish it here.
