  • domicile -being outside the US- affidavit of support

    Hello all,

I am married to a US citizen. I am holding F-1. We are now in the US but we will leave soon for 1 or 2 years for my research. Unfortunately, we are going to leave soon, so we won't have a chance for Adjustment of Status.

Anyway, I've decided to apply for CR-1 after my spouse submits I-130 along with other documents. However, we are confused about the affidavit of support.

My spouse will be with me in my home country in this 1 or 2 years -it is not certain yet because we do not know how long the CR-1 process and my research will take there. As far as we understand, my spouse cannot be a sponsor for me because she won't be in the US with some income. So we thought my spouse's parents can be a sponsor for me.

However, apparently, the petitioner must be domicile in the US. But my spouse won't be in the US. As I wrote before, she will be with me in my home country. Is there any way to show that she is domicile in the US? We will definitely go back to the US when I am done with my research in my home country.

We do not have a house, car, or other assets in the US. We have a joint account along with our personal accounts though if this information helps.
What we thought is that my spouse can just register her residency as her parents' house although she will be in my home country. So she will be domicile but she won't have a job in the US. Rather, it will seem like she lives with her parents without having income. Her parents will sponsor me but my spouse will be able to give the petition in this scenario. Does this work?

    Thank you so much
