  • Does some one need to maintain F-1 status after filing I-485 through F2A category

    Hello,

Currently, I am in F1 status and willing to send a complete packet of I-485 (adjustment of status along with EAD and travel document) on the first week of October. I am worried if I need to maintain F-1 status because I am in OPT and my OPT expires in November 2017. Please let me know if some one had gone through similar situation. Your help would be really appreciate. Thank you.

You need to be in status at the time I-485 is filed (assuming you are eligible to file at that time), because you are not in the Immediate Relative category. After that, no, you don't need to maintain status; you can stay in the US for as long as I-485 is pending regardless of whether you have status. This is true regardless of category. Note that once you file I-485, you should not leave the US unless you receive a green card or Advance Parole.
