I am US citizen, my wife is Mexican citizen. We were married May 05 and began our paper trail in Aug 05. My wife has a Border Crossing Card and currently a guest visa too. I called USCIS in Aug 05 to see what steps to take in obtaining a green card for my wife and was told I could file an I-486 but that she would then not be able to leave the US until it was approved. My wife has rheumatoid arthristis (RA) and is currently on disablility from her job in Mexico for 2 years, she sees her doctor in Mexico who treats her for RA and as such it was not be feasible for her to remain here in the US 9+ months waiting on the I-486. I explained this to USCIS and they said the other way was to file I-130, G-325A for me and the wife, and that she could visit me using the BCC (72 hour limit on stays) and also the guest visa for extended stays (we live in San Diego). This would allow us not to have to be separated during this time and also allow my wife to travel to and from Mexico. My wife owns her own home in Mexico, and as I mentioned, is currently on a temporary leave of absense from work while on disability. So we started filing our paperwork the latter way. I have since also filed the I-130, G-325A ,I-864P as requested. We have also been requested to submit the DS-230 now and that will be going out within the next week or so. I understand once the DS-230 is received, the paperwork should be forwarded to Cuidad Juarez.
But now that I read some of the messages on this board, it almost seems like we are doing something wrong because my wife is staying with me. The 72 hour rule of the BCC has never come into play because she's always had the guest visa. She travels to/from Mexico 3-4 times a month to check on our home there, doctor visits, etc. They've given my wife a new guest visa every time her old one has expired.
If we get scheduled for an interview in Juarez and she gives the above story, it doesn't sound like it would fly very well. At this point, would it be better to simply file the I-486 and forget about Juarez? Would this cause a delay? My wife is now on my insurance plan at work so she's began RA treatment here in the US, so not traveling to Mexico is not as big an issue as it was last year. The person I spoke with at USCIS last year really made it sound like the consular route was the way to go, but I'm not so sure now. It seems like my wife staying here with me during the wait to the interview in Juarez is frowned upon.
We certainly want to cross all our T and dot all our I's in this process, so any ideas or feedback from anyone with a similar experience would be greatly appreciated.
