  • Pending F4 - Could I be denied entry to the US from Canada?

Will I have any problems crossing the border into the U.S.A. from Canada if my American sister sponsors me for a Green Card?

My sister recently became a US citizen. I am Canadian, born in Canada. I'd like to be sponsored by my sister for a green card (F4 category), but am wondering if a pending green card application could cause any problems crossing into the US from Canada for vacations during the long wait to get my green card (about 12+ years currently). Could I be denied entry because of the pending application?

    You could be.

The border agent needs to think that you are not going to overstay your visitor visa. Submitting the I-130 shows that you do intend to move the the US already. Bring evidence of your ongoing ties to Canada: enrollment in school, ongoing lease agreement, a letter from your job, etc... Stuff that makes it obvious that you plan to go back. Still no guarantees.
