  • I-864 Question

    Hi,

I have applied a green card for my husband through F2A category and the priority date is currnt. I was filling I-864 form and we are using his income as a spouse to support me in affidavit of support. I-864 instructions says, you must provide evidence that his/her income will continue from the current source after obtaining lawful permanent resident status, and the intending immigrant must provide evidence that he or she is living in your residence. Does this mean that he cannot switch jobs in beetween untill he compeltes 2 years (approx) after getting green card?

No. He can switch jobs. Nobody can predict job changes in the future. I think this is mainly for immigrants who are applying from abroad, who are working in their home country but cannot continue their jobs once they immigrate to the US. If he is working legally in the US, it is usually assumed that he can continue it after he becomes a permanent resident.

This is my personal opinion and is not to be construed as legal advice.
