  • filing for green card while living in different states

    Hello,

My name is King and my fiancee and I are getting married in tomorrow. She is a U.S citizen but we live in different states. We got our marriage lisence in Maryland, where she lives currently with her family and we are going to get married in Maryland as well. I live in Memphis, TN (with my family) and we wanted to file the Green Card application as soon as possible, so that by the time I move to Maryland or she moves to Memphis, I would be able to work. I am currently an F-1 student. We would like to know if we could file the application in a month period even though we will not be able to live together for at least 4 months. Also, how long does it take for me to get my work authorization card, which will allow me to work, therefore, making easier for me to move here is Maryland or for her to move to Memphis.

    Thank you,

    King

    Please Help!!!!!!!!

    Hello,

My name is King and my fiancee and I are now married. She is a U.S citizen but we live in different states. I heard that you the INS may become suspicious if you dont live together, but can they reject the application on that ground?

    Please advise

    Thank you,

    King

I had answered these questions from you before. Yes, you can file now even though you dont live in the same states right now. Youre in school in another state, thats a perfectly legitimate reason not to be living together. your application is not going to be denied simply because you lived separate and apart. The USCIS is going to look at a the totality of the marriage and make a determination as to whether this is a valid marriage or not so because you lived apart for a short while does not make it any fraudulent. Also your interview is another 6-12 months away.

Your work authorization will take 2-3 months
